FCC proposal aimed at foreign “military-grade” drones could also affect agricultural spray platforms, highlighting emerging policy questions.
When the Federal Communications Commission (FCC) announced on July 21 that it was seeking public comment on whether to prohibit the importation and sale of additional categories of foreign-produced “military-grade” drones, most attention focused on thermal imaging, swarming, and other defense-related capabilities. But one proposed category could have significant implications for agriculture.
The FCC’s Public Notice proposes extending restrictions to several categories of foreign-produced drones on the Covered List, including “aerosol drones capable of dispensing ‘economic poison'” under FAA rules. The legal term “economic poison” refers to pesticides and other agricultural chemicals, meaning the proposed language encompasses agricultural spraying drones as well as any comparable military systems.
That language is particularly relevant because one of the companies identified in the proceeding is Guangzhou XAG Technology (XAG), one of the world’s largest agricultural drone manufacturers. While the FCC has not proposed banning agricultural drones as a category, the inclusion of aerosol-dispensing aircraft means some foreign agricultural platforms could fall within the proposal if adopted.
The proposal also creates an interesting contrast with the FCC’s recent efforts to establish a pathway for trusted agricultural drone suppliers. In recent months, the agency has granted conditional approvals to multiple manufacturers, including Vermont-based Ceres Air, allowing qualifying agricultural drone platforms to continue receiving FCC equipment authorizations under the agency’s exemption process.
Taken together, the actions suggest the FCC is pursuing two parallel objectives: expanding opportunities for trusted suppliers while seeking comment on whether certain categories of foreign-produced drones, including agricultural spray aircraft, should no longer be eligible for importation or sale.
For the agriculture industry, the proceeding bears watching. Precision spraying has become one of the fastest-growing commercial drone applications, and many operators rely on foreign-manufactured aircraft. Whether the FCC ultimately adopts the proposed restrictions, narrows their scope, or creates additional exceptions will likely depend in part on the public comments received before the rulemaking moves forward.
